1. Introduction
These Website Standard Terms and Conditions written on this webpage shall manage your use of our website, NRG TOKEN accessible at https://nrgtoken.io/ These Terms will be applied fully and affect to your use of this Website. By using this Website, you agreed to accept all terms and conditions written in here. You must not use this Website if you disagree with any of these Website Standard Terms and Conditions. Minors or people below 18 years old are not allowed to use this Website.
2. Intellectual Property Rights
Under these Terms, SERVICIOS Y DESARROLLOS MTMX SRL de CV and/or its licensors own all the intellectual property rights and materials contained in this Website. You are granted limited license only for purposes of viewing the material contained on this Website.
3. Restrictions
You are specifically restricted from all of the following: • publishing any Website material in any other media • selling, sublicensing and/or otherwise commercializing any Website material; • using this Website in any way that is or may be damaging to this Website; • using this Website in any way that impacts user access to this Website • using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity; • engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website; • using this Website to engage in any advertising or marketing.
4 OWNERSHIP
You are the sole owner of the FNFT. Each FNFT is on the frqtal blockchain. When you buy an FNFT, you own TOKEN, the Art, that it is based on. The FNFTs ownership is entirely mediated by the Smart Contract and the FRQTAL Network: we may never seize, freeze, or otherwise modify the ownership of any SolarPigs.
Individual Use. We give you a royalty-free, unrestricted license to use, reproduce, and display the purchased Art, along with any add-ons you decide to make or use, solely for the following goals, provided that you continue to abide by these Terms. (1) for your own private, non-commercial use; (2) as a component of a market place that allows the buying and selling of your FNFT, provided that the market place cryptographically verifies each FNFT owner's right to display the Art for their TOKEN to ensure that only the real owner can display the Art; or (3) as a component of a third-party website or application that allows the inclusion, participation, or use of your FNFT, provided that the website/application cryptographically verifies each FNFTowner's right to display the Art for their FNFT to ensure that only the actual owner can display the Art, and provided that the Art is made inaccessible once the owner of the FNFT leaves the website/application.
Commercial Use. Subject to your continuous compliance with these Terms, we grant you an unrestricted, worldwide license to use, copy, and display the bought Art for the purpose of creating derivative works ("Commercial Use"). Examples of such Commercial Use include the production and sale of items (T-shirts, etc.) with reproductions of the Work. Nothing in this Section shall be construed to restrict you from (1) owning or operating a marketplace that permits the use and sale of FNFT generally, provided that the marketplace cryptographically verifies each FNFT owner's rights to display the Art for their FNFT to ensure that only the actual owner can display the Art; (2) owning or running a third-party website or application that allows FNFT to be included, involved, or used in general, as long as the third-party website or application cryptographically verifies each FNFT owner's rights to display the Art for their FNFT to make sure that only the actual owner can display the Art and as long as the Art is no longer visible once the owner of the Purchased NRG TOKEN leaves the website/application; or (3i) earning revenue from any of the foregoing.
NRG TOKEN Intellectual Property. Other than the rights to the Art, nothing in this Agreement grants you any rights to any other FNFT trademarks or intellectual property rights, including, without limitation, NRG TOKEN and the associated logos. All of these rights are expressly reserved by the SERVICIOS Y DESARROLLOS MTMX SRL de CV
Feedback. You have the option to provide feedback on the site, including suggestions for improvements (collectively "Feedback"), problem reports, ideas, or other feedback. By providing any feedback, you agree that we may use it anyway we see fit without having to pay you additional fees. You hereby grant us a perpetual, irrevocable, nonexclusive, global license to incorporate and utilize the feedback however we see fit.
5 fees and payment
Any financial transactions you make if you decide to buy a NRG TOKEN on the Site or APP will only be made over the frqtal network. We won't know about or be able to influence any payments or transactions, and we also lack the power to stop any of them. For any claims or losses that may follow from any transactions you participate in or any transactions you carry out over the FRQTAL network, we shall not be liable to you or any other party.
Every transaction that takes place on the FRQTAL network is subject to a transaction cost, known as a "Gas Fee." The decentralized FRQTAL network's computer network is financed by the "Gas Fee." You will thus be required to pay a Gas Fee for each transaction.
6 DISCLAIMERS
You acknowledge and agree that the site is provided "as is" and "as available" without any express or implied warranties and that your access to and use of the site are at your sole risk. To the maximum extent permitted by applicable law, we make no express warranties and disclaim all implied warranties regarding the site and any portion thereof (including, without limitation, the site, any smart contract, and any external websites), including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, correctness, accuracy, and reliability. Without limiting the generality of the aforementioned, we, our subsidiaries, affiliates, and licensors do not represent or warrant to you that: (1) your access to or use of the site will satisfy your requirements; (2) your access to or use of the site or APP will be timely, uninterrupted, secure, or free from errors; (3) usage data provided through the site will be accurate; or (4) the site or any content, services, or features made available on or through the site are free of viruses or other harmful components; or (5) that the site will protect any information you disclose while using it. Some or all of the aforementioned exclusions may not apply to you because some jurisdictions do not permit the exclusion of implied warranties in contracts with consumers.
You acknowledge that there are security risks associated with giving out personal information and transacting online via the internet, and you agree that we are not liable or responsible for any security breach unless it was the result of our willful misconduct.
We neither control nor provide any warranties for any smart contracts, nor will we be held accountable for any losses you suffer as a result of using the FRQTAL network.
7. LIMITATIONS
You acknowledge and agree that, regardless of the cause or the theory of liability, we will not be liable to you or any third party for any indirect, incidental, special, consequential, or exemplary damages that you may suffer, including, without limitation, any loss of profits (whether incurred directly or indirectly), loss of goodwill or business reputation, loss of data, cost of procurement of substitute goods or services, or any other intangible loss.
You understand and agree that the warranty exclusions and liability restrictions contained in this agreement are the reason we made the site available to you and entered into these terms. Without these restrictions, we would not be able to offer you the site.
8. Risk Assumption
If you decide to sell your FNFT, please be advised that FNFT prices are incredibly volatile and that changes in the pricing of other FNFTs can both positively and negatively affect the price of your FNFT. FNFTs shouldn't be viewed as investments due of the volatility. You voluntarily accept any associated risks.
You accept all risks associated with using an Internet-based currency, including, but not limited to, the risk of hardware, software, and Internet connections failing, the risk of malicious software being introduced, and the risk that third parties gaining unauthorized access to information stored in your wallet.
Because FNFT, cryptocurrencies, and blockchain technology are new, the regulatory landscape is uncertain. New laws may have a negative influence on such technology, lowering the value of your FNFT You are aware of and accept any risks in this regard.
You accept full responsibility for any negative consequences resulting from disruptions or other issues affecting FRQTAL app or the FRQTAL network.
We reserve the right to adapt, change, or reduce the roadmap and plans of the project.
This project is strictly an FNFT project that could eventually provide utilities for its holders. The project plans to distribute the proceeds from the sale of solar energy. The amount of payments depends entirely on electricity prices, seasons and the internal system of the project. However, we do not guarantee any profitability for the buyers.
